Patente, Erfindungen, Urheber- und sonstige Schutzrechte
(1) Der GESCHÄFTSFÜHRER überträgt der GESELLSCHAFT das ausschließliche, zeitlich, räumlich und inhaltlich unbeschränkte Nutzungs- und Verwertungsrecht für alle etwaigen patentfähigen, urheberrechtsfähigen oder sonst nach Marken-, Geschmacksmuster- und/ oder Gebrauchsmusterrecht oder irgendeinem anderen Schutzrecht schutzfähigen Arbeitsergebnisse, die der GESCHÄFTSFÜHRER während der Dauer seines Anstellungsverhältnisses, innerhalb oder außerhalb seiner Arbeitszeit erstellt, sofern sie die Geschäftstätigkeit der GESELLSCHAFT und ihrer verbundenen Unternehmen betreffen. Die Übertragung des Nutzungs- und Verwertungsrechts umfasst die Erlaubnis zur Bearbeitung und Lizenzvergabe an Dritte und ist vollumfänglich mit der unter vorstehendem § 4 geregelten Vergütung abgegolten. Der GESCHÄFTSFÜHRER verzichtet ausdrücklich auf alle sonstigen ihm etwa als Urheber oder sonstiger Schutzrechtsinhaber zustehenden Rechte an den oben genannten Arbeitsergebnissen, insbesondere auf das Recht auf Namensnennung und auf Zugänglichmachung des Werkes.
(2) Soweit der GESCHÄFTSFÜHRER im Zusammenhang mit seiner Tätigkeit für die GESELLSCHAFT patentfähige Erfindungen und sonstige technische Entwicklungen oder Know-How, ein-schließlich Software, Konzepte, Pläne, Entwürfe, Datensammlungen oder sonstige recht-lich schutzfähige Arbeitsergebnisse schafft, stehen alle Rechte an diesen Arbeitsergebnis-sen allein der GESELLSCHAFT zu. Die Rechte gehen mit ihrem Entstehen auf die GESELLSCHAFT über, ohne dass es einer weiteren Erklärung des GESCHÄFTSFÜHRERS oder der GESELLSCHAFT bedarf.
(3) Der GESCHÄFTSFÜHRER ist verpflichtet, die GESELLSCHAFT unverzüglich und schriftlich über alle schutzfähigen Arbeitsergebnisse im Sinne dieser Bestimmung zu informieren, um ihr die Wahrung ihrer Rechte zu ermöglichen.

Patents, Inventions , Copyright and Other Intellectual Property Rights
(1) The DIRECTOR gives the COMPANY exclusive and unlimited time, space, and content exploitation and patent rights to any and all patentable and copyrightable work product as well as to any other brand, design, and/ or utility models or any other work product that could be protected as intellectual property created by the DIRECTOR during the term of his contract of employment within or outside of his working hours, provided that they relate to the operations of the COMPANY and its affiliates. This transfer of patent rights and copyrights includes permissions to third parties for editing and licensing and is fully compensated by the remuneration recited under § 4. The DIRECTOR expressly waives all rights as creator or other intellectual property rights to the above mentioned work product, particularly the right to be named and to make the work available to others.
(2) Should the DIRECTOR create in connection with his work for the COMPANY patentable inventions and other technical developments or know-how, including software, drafts, plans, designs, data collection or other legally patentable work product, all rights to such work product are retained solely by the COMPANY. The rights to any such work product transfer immediately to the COMPANY upon its creation without the need for further explanation by the DIRECTOR or COMPANY.
(3) The DIRECTOR is obligated to inform the COMPANY immediately and in writing of any patentable work product within the meaning of this provision so as to enable the COMPANY to protect its rights.
