LVFS 2009:8 Läkemedelsverkets föreskrifter
om ansökan om tillstånd
att bedriva öppenvårdsapotek;
beslutade den 14 juni 2009.
Läkemedelsverket meddelar med stöd av 14 § 7 och 15 § förordningen (2009:659) om handel med läkemedel följande föreskrifter om ansökan om tillstånd att bedriva öppenvårdsapotek.
Tillämpningsområde
1 § Dessa föreskrifter ska tillämpas på sådan ansökan om tillstånd som av¬ses i 2 kap. 1 § lagen (2009:366) om handel med läkemedel.
Definitioner
2 § Termer och begrepp som används i lagen (2009:366) om handel med lä¬kemedel har samma betydelse i dessa föreskrifter. Med farmaceut avses den som är behörig att utöva yrke som apotekare eller receptarie enligt 3 kap. 4 § lagen (1998:531) om yrkesverksamhet på hälso- och sjukvårdens område.
Ansökan
3 § Vid ansökan om tillstånd att bedriva öppenvårdsapotek ska antingen formulär fastställt av Läkemedelsverket, se bilaga till dessa föreskrifter, eller elektroniskt formulär som tillhandahålls på Läkemedelsverkets webbplats1 användas. Ansökan ska innehålla de uppgifter och handlingar som anges i 4–18 §§.
Ansökningshandlingarna ska vara avfattade på svenska eller engelska. Översättning av handlingar ska vara utförd av en auktoriserad translator2 eller någon som har motsvarande utländsk behörighet.
Ansökans innehåll
Förbud mot beviljande av tillstånd
4 § Sökanden ska i ansökan uppge om det föreligger sådana förhållanden som anges i 2 kap. 5 § första stycket lagen (2009:366) om handel med läke¬medel som utgör hinder för beviljande av tillstånd. De särskilda skäl som sökanden vill åberopa som grund för undantag från förbudet att bevilja till¬

Personlig och ekonomisk lämplighet
Företag
5 § Ansökan ska innehålla följande uppgifter och handlingar angående den sökande juridiska personen.
1. Firma och organisationsnummer.
2. Registreringsbevis från Bolagsverket.
3. Registerutdrag som visar att ingen skuld finns hos Kronofogdemyndig¬heten eller, om sådant inte kan erhållas, ett utdrag från Kronofogdemyn¬dighetens utsökningsregister.
4. Redogörelse för företagets verksamhet och organisation. Bevis och registerutdrag får inte vara äldre än tre månader. För företag som inte är registrerade i Sverige ska handlingar som motsvarar
de ovan angivna inges.
Personer
6 § Ansökan ska innehålla följande uppgifter och handlingar avseende fy¬sisk person som är sökande eller den eller de personer med betydande infly¬tande i en sökande juridisk person. Personer med betydande inflytande är verkställande direktör, styrelseledamot, bolagsdelägare eller aktieägare med betydande aktieinnehav samt annan person med betydande ekonomiskt in¬tresse i företaget.
1. Namn och personnummer.
2. Bevis från Bolagsverket om uppdrag som funktionär.
3. Bevis ur Bolagsverkets näringsförbudsregister och register över fysiska personers konkurser.
4. Registerutdrag som visar att ingen skuld finns hos Kronofogdemyndig¬heten eller, om sådant inte kan erhållas, ett utdrag från Kronofogdemyn¬dighetens utsökningsregister.
Bevis och registerutdrag får inte vara äldre än tre månader. För person som inte har sin hemvist i Sverige ska handlingar som motsva¬rar de ovan angivna inges.
Uppgift om bedrivande av viss verksamhet
7 § Om sökanden bedriver verksamhet som anges i 2 kap. 5 § andra och tredje stycket lagen (2009:366) om handel med läkemedel ska det anges i an¬sökan.
Åberopande av uppgifter och handlingar
8 § För det fall uppgifter och handlingar enligt 4–7 §§ getts in till Läkeme¬delsverket med anledning av en tidigare ansökan om tillstånd att bedriva öppenvårdsapotek kan dessa åberopas om förhållandena inte har ändrats. Detta gäller även bevis och registerutdrag som är äldre än tre månader.
Kontaktuppgifter LVFS 2009:8 9 § Följande kontaktuppgifter ska anges i ansökan.
1. Sökandens postadress, telefonnummer, telefaxnummer och e-post¬adress.
2. Öppenvårdsapotekets namn, besöksadress, telefonnummer, telefaxnum¬mer och e-postadress.
3. Besöksadress, telefonnummer, telefaxnummer och e-postadress till and¬ra lokaler där delar av verksamheten ska bedrivas.
Om det vid ansökningstillfället saknas uppgifter enligt första stycket 2 och 3 ska det anges särskilt och komplettering ges in till Läkemedelsverket så snart uppgifterna finns.
Beskrivning av verksamheten
10 § Sökanden ska beskriva den verksamhet som avses bedrivas vid öppen¬vårdsapoteket. Det ska även anges om annan verksamhet än apoteksverksam¬het avses bedrivas i, eller i anslutning till, öppenvårdsapotekets lokaler. Om distanshandel, maskinell dosdispensering, extemporetillverkning eller för¬säljning av teknisk sprit ska bedrivas ska detta anges.
Förutsättningar för verksamhetens bedrivande
11 § Enligt 2 kap. 4 § lagen (2009:366) om handel med läkemedel ska sö¬kanden visa att sökanden har förutsättningar att uppfylla de i 2 kap. 6 § angiv¬na kraven för verksamhetens bedrivande. I ansökan ska uppgifter lämnas som visar att sådana förutsättningar finns.
Farmaceuts närvaro under öppethållande
12 § En bemanningsplan som visar att farmaceut kommer att finnas närva¬rande under öppenvårdsapotekets hela öppethållande ska bifogas ansökan. Av planen ska även framgå att antalet närvarande farmaceuter är tillräckligt och att de har den kompetens som är nödvändig med hänsyn till verksamhe¬tens art och omfattning.
Lokaler
13 § Ritningar över de lokaler där öppenvårdsapotekets verksamhet ska be¬drivas ska bifogas ansökan. Sökanden ska visa hur lokalerna ska anpassas och utrustas för den planerade verksamheten. Om dokumentation ska arkiveras i annan lokal ska detta anges särskilt.
Tillhandahållandeskyldighet
14 § Sökanden ska genom avtal eller på annat sätt visa att kraven på tillhandahållandeskyldighet enligt 2 kap. 6 § 3 lagen (2009:366) om handel med läkemedel och 9 § förordningen (2009:659) om handel med läkemedel kan fullgöras.
Läkemedelsansvarig
15 § Angående den person som ska vara läkemedelsansvarig ska ansökan innehålla följande uppgifter och handlingar.
1. Namn och personnummer.
2. En bestyrkt kopia av legitimation eller särskilt förordnande att utöva yrke som apotekare eller receptarie.3
3. För receptarie, beskrivning av relevant yrkeserfarenhet och i förekom¬mande fall farmaceutisk vidareutbildning.
4. Kontaktuppgifter såsom telefonnummer och e-postadress.
Om det vid ansökningstillfället saknas uppgifter eller handlingar enligt för¬sta stycket 1–4 ska det anges särskilt och komplettering ges in till Läkeme¬delsverket så snart de finns.
16 § För det fall den person som angetts som läkemedelsansvarig redan har ett sådant ansvar på annat öppenvårdsapotek ska detta apotek anges. Om en läkemedelsansvarig avses ansvara för fler än tre öppenvårdsapotek ska det i ansökan anges vilka särskilda skäl som åberopas för undantag från bestäm¬melsen i 2 kap. 8 § första stycket lagen (2009:366) om handel med läkeme¬del.
Elektronisk överföring av uppgifter
17 § Sökanden ska genom intyg från Apotekens Service Aktiebolag visa att förutsättningar finns för momentan överföring av och direktåtkomst till upp¬gifter i enlighet med 2 kap. 6 § 5 och 6 lagen (2009:366) om handel med läke¬medel. Intyget ska även visa att förutsättningar finns för säker överföring av uppgifterna.
18 § Sökanden ska genom intyg från Apotekens Service Aktiebolag visa att förutsättningar finns för säker överföring av uppgifter till Apotekens Service Aktiebolag i enlighet med 2 kap. 6 § 7 och 4 kap. 2 § lagen (2009:366) om handel med läkemedel samt 11–13 §§ förordningen (2009:659) om handel med läkemedel.
Anmälan
19 § Sådan väsentlig förändring som avses i 2 kap. 10 § lagen (2009:366) om handel med läkemedel ska om möjligt anmälas till Läkemedelsverket se¬nast två månader innan ändringen vidtas, annars så snart det kan ske. Andra ändringar av uppgifter som angetts i ansökan ska anmälas till Läkemedelsver¬ket så snart det kan ske.
Dispens
20 § Läkemedelsverket kan i enskilda fall meddela undantag (dispens) från bestämmelserna i dessa föreskrifter.

The Medical Products Agency regulations
on applications for permission to operate
outpatient pharmacies.
Ratified 14 June 2009.
By virtue of paras 14.7 and 15 of the Ordinance (2009:659) on the trade in medical products, the Medical Products Agency publishes the following regulations on applications for permission to operate outpatient pharmacies.
Scope
1. These regulations are to apply to those applications for permission which are covered in Chapter 2.1 of the Act (2009:366) on the trade in medical products.
Definitions
2. Terms and definitions which are used in the Act (2009:366) on the trade in medical products have the same meanings in these regulations. The word Pharmacist refers to the person who is responsible for carrying out the work of a pharmacist or a dispenser according to Chapter 3.4 of the Act (1998:531) on professional activity in the health care field.
Applications
3. Applicants for permission to operate outpatient pharmacies, are to use either the form directed by the Medical Products Agency (see Annex to these regulations) or the electronic form which can be found in the Medical Products Agency’s website . The application is to include the information and documents laid down in paras 4 – 18 below.
The application documents are to be in Swedish or English. Translations of documents are to be carried out by a certified translator or a person with a corresponding foreign qualification.
Application contents
Prohibition against granting permission
4. In the application, the applicant is to show if there are any circumstances as laid down in the first section of Chapter 2.5 of the Act (2009:366) on the trade in medical products, which could prevent granting permission. The special reasons

which the applicant wishes to represent as grounds for exception from prohibition against granting permission in accordance with the last section of Chapter 2.5 of the Act on the trade in medical products, are to be explained.
Personal and financial suitability
Companies
5. The application is to include the following information and documents on the applicant legal entity.
1. Company name and registered number.
2. Proof of registration from the Companies Registration Office.
3. Extract of register which shows no debts outstanding at the Debt Enforcement Agency, or if this cannot be obtained, an extract from the Debt Enforcement Agency’s debt recovery register.
4. A description of the company’s business and organisation.
Proofs and extracts are not to be more than three months old.
For companies not registered in Sweden, documents corresponding to the above are to be provided.
People
6. The application is to include the following information and documents on the actual person who is applying or on those people with significant influence within the applicant legal entity. People with significant influence are the managing director, board members, partners or shareholders with a significant number of shares and any other person with a significant financial interest in the company.
1. Name and identity number.
2. Proof of position in company from Companies Registration Office.
3. Proof from the Companies Registration Office disqualification register and the register on individuals bankruptcies.
4. Extract from the register which shows no debts outstanding at the Debt Enforcement Agency or, if this cannot be obtained, an extract from the Debt Enforcement Agency’s debt recovery register.
Proofs and extracts are not to be more than three months old.
For people not domiciled in Sweden, documents corresponding to the above are to be provided.
Information on the pursuance of certain activities
7. If the applicant pursues activities covered in the second and third sections of Chapter 2.5 of the Act (2009:366) on the trade in medical products, this is to be reported in the application.
Referencing information and documents
8. Where information and documents in accordance with paras 4 – 7 above have been passed to the Medical Products Agency for the purposes of a previous application for permission to operate outpatient pharmacies, these may be referenced so long as circumstances have not changed. This also applies to proof and register extracts which are over three months old.

Contact details
9. The following contact details are to be supplied in the application.
1. Applicant’s postal address, telephone number, fax number and e-mail address.
2. Outpatient pharmacy name, street address, telephone number, fax number and e-mail address.
3. The street addresses, telephone numbers, fax numbers and e-mail addresses of other sites where parts of the business are to be conducted.
If at the time of the application information in accordance with sub-paragraphs 1 and 2 above is not available, a note should be made to this effect and the information passed to the Medical Products Agency as soon as it is available.
Description of business
10. The applicant is to describe the business which is intended to be conducted at the outpatient pharmacy. It is also to be reported whether any other business besides pharmacy work is intended to be conducted in, or in connection with, the outpatient pharmacy sites. If any distance shopping, mechanical dispensing, making-up extempore pharmaceuticals or selling industrial alcohol is to be conducted, these are also to be reported.
Requirements for business operations
11. In accordance with Chapter 2.4 of the Act (2009:366) on the trade in medical products, the applicant is required to fulfil the conditions in Chapter 2.6 concerning requirements for business operations. Information which shows that such conditions exist is to be included in the application.
Pharmacist’s presence during opening hours
12. A personnel plan showing that a pharmacist will be present throughout the opening hours of the outpatient pharmacy is to be submitted with the application. This plan is to demonstrate that the number of pharmacists available is sufficient and that they have the skills necessary with regard to the type and extent of the business.
Sites
13. Drawings of the sites where the outpatient pharmacy business is to be conducted are to be submitted with the application. The applicant is to show how the sites are to be adapted and equipped for the planned business. If it is planned to archive documentation in a separate site, this is to be specially reported.
Responsibility for supply
14. The applicant is to show by contracts or other means that the requirements for responsibility for supply in accordance with Chapter 2.6 para 3 of the Act (2009:366) on the trade in medical products and para 9 of the Ordinance (2009:659) on the trade in medical products, can be fulfilled.

Medical products manager
15. The applicant is to provide the following information and documents on the person who is to be the medical products manager.
1. Name and identity number.
2. A certified copy of his/her certificate or special authorisation to practise as a pharmacist or a dispenser.
3. For a dispenser, a description of relevant work experience and, when appropriate, further pharmaceutical training.
4. Contact details such as telephone number and e-mail address.
If the information or documents required by sub-paras 1-4 above is not available at the time the application is submitted, a note should be made to this effect and the information passed to the Medical Products Agency as soon as it is available.
16. Where the person who is to be the medical products manager already holds a similar position in another outpatient pharmacy, the name of this pharmacy is to be reported. If one medical products manager is intended to be responsible for more than three outpatient pharmacies, the application is to include a statement on what special reasons are being invoked for an exception to the rule in the first section of Chapter 2.8 of the Act (2009:366) on the trade in medical products.
Electronic transfer of information
17. By means of certification by Apotekens Service Aktiebolag (Pharmacy Service PLC), the applicant is to show that conditions exist for the instantaneous transfer of, and direct access to, information in accordance with Chapter 2.5 paras 5 and 6 of the Act (2009:366) on the trade in medical products. This certification is also to show that conditions exist for the secure transfer of information.
18. By means of certification by Apotekens Service Aktiebolag, the applicant is to show that conditions exist for the secure transfer of information to Apotekens Service Aktiebolag in accordance with Chapter 2.6 paras 7 and 4 of the Act (2009:366) on the trade in medical products, and paras 11- 13 of the Ordinance (2009:659) on the trade in medical products.
Notification
19. Any material change such as that referred to in Chapter 2.10 of the Act (2009:366) on trade in drugs is, if possible, to be notified to the Medical Products Agency not later than two months before the change is made, otherwise as soon as it can be done. Other changes of information included in the application are to be notified to the Medical Products Agency at the earliest possible opportunity.
Dispensations
20. The Medical products Agency can in certain cases grant exceptions (dispensations) to the rules in these regulations.
