Order of Distribution
The Estate cannot be distributed until all debts and expenses have been paid. Once this has been done, then if the Estate has both legacy beneficiaries and residuary beneficiaries, there is a strict order in which the rest of the Estate must be distributed.
Legacy beneficiaries are entitled to receive their inheritance first. Once these legacies have been paid, then the remaining Estate will be divided between the residuary beneficiaries.

Note a beneficiary who takes all, so is residuary > 'universal' etc. post-distribution of legacies and inheritance or capital gains taxes > equals a *legatee* of specific bequests like personalty: money, goods so chattels / moveable in Scots Roman civil law or *devisees* of realty, namely of land.
The specific bequest or legacy vests mortis causa by operation of death, so passes dehors or outside of the Will: rather than needs to be 'assented' so distibuted by the testamentary executors.
Under the Polish Civil Code, a specific legacy can either *vest directly in the legatee under the doctrine of vindication*, or via residue so that it becomes an obligation of the heirs under the doctrine of damnation.
legatum per vindicationem .. when it refers to property located in another country whose laws do not provide for such legacies ... (i.e. where the death of the legator does not result in an *automatic transfer* of the object of the legacy to the legatee)
