Hello there,
I am bogged down in trying to understand one thing in a legal text:
Jednání žalovaného v podobě registrace domény je jednáním v hospodářské soutěži.
Podle relevantní literatury a judikatury je ***jednání v hospodářské soutěži jednání, které může mít jakýkoliv nepříznivý vliv na hospodářskou soutěž***, přičemž soutěžní vztah není omezován jen na vztah subjektů konkurujících si trvale v hospodářské soutěži, ale i na vztah soutěže „ad hoc“, tedy na vztah založený jen určitým úkonem při existenci soutěžního záměru jednajícího získat určitý prospěch či výhodu v ekonomickém svém postavení na úkor postavení jiného subjektu v jeho postavení v hospodářské soutěži

I cannot understand why the text says that “jednání v hospodářské soutěži” is “jednání, které může mít jakýkoliv nepříznivý vliv na hospodářskou soutěž” – I am a bit concerned that there might be an error in the ST because it makes no sense for (literally) “actions in economic competition” to be “actions which can have any adverse effect on economic competition”. Perhaps “jednání v hospodářské soutěži” can be used in the sense of “anticompetitive practices” (although I do not see how). Most of the hits I get for jednání v hospodářské soutěži lead me towards Article 44 of the Czech Commercial Code: "Nekalou soutěží je jednání v hospodářské soutěži, které je v rozporu s dobrými mravy soutěže" – now I could understand nekala soutez being defined as having a nepříznivý vliv na hospodářskou soutěž, but how can jednání v hospodářské soutěži have a nepříznivý vliv na hospodářskou soutěž?? Am I right in smelling a rat or have I misinterpreted jednání v hospodářské soutěži?

Thanks to everyone for everything. My problem was that according to the Czech "jednani v hospodarske soutezi" is unfair, which is nonsense. "jednání v hospodářské soutěži [je] jednání, které může mít jakýkoliv nepříznivý vliv na hospodářskou soutěž" simply does not make sense. I understand what Jan and Maria are saying about Article 44, but the fact remains that the Czech just says "jednání v hospodářské soutěži" and not "jednani v hospodarske soutezi, ktere je v rozporu s dobrymi mravy souteze" - "jednani v hospodarske soutezi" cannot on its own/in itself be unfair or have an adverse effect on competition.... there is something missing.

jednani - dohody mezi souteziteli, rozhodnuti jejich sdruzeni a jednani soutezitelu ve vzajemne shode jejichz cilem je naruseni hospodarske souteze, jsou zakazane a neplatne.

Nekala soutez - "Unfair business practices encompass fraud, misrepresentation, and apppressive or unconsciouable acts or practices by business, often against consumers and are prohibited by law in many countries. For instance, in the EU, each member state must regulate unfair b.p. in accordance with the Unfair Commercial Practices Directive, subject to transitional periods.

Tento problém (dohodu o cenách, tzn. kartelové dohody) upravuje zákon o ochraně hospodářské soutěže 143/2001 Sb. Co jsou jednotlivá jednání nekalé soutěže stanoví taxativně § 44 (2) ObchZ - a) klamavá reklama atd.

perhaps the unfair element is when a group of companies act together to fix prices, as a monopoly would act on its own, hence oligopoly. Sort of like OPEC. It is against the principles of competition.

Sorry but still a bit bemused... Thank you to all of you for your input. Sorry if I am being a bit stupid (it's the end of the week) but I still do not get how it is possible that jednání v hospodářské soutězi could have a nepříznivý vliv na hospodářskou soutěž...? jednání v hospodářské soutězi is surely just normal business activity isn't it....? Basically the text is saying "actions/activity in economic competition" -> maybe "adverse effect on competition"? That to my mind is illogical. If it was jednání v rozporu s hospodářskou soutězí then fine. Maria's "unfair business practices" would make sense but how do you get that from "jednání v hospodářské soutězi" (i.e. where does the "unfair" bit come from? Am I making sense?

Charles, I think the key word in the sentence is "může" - if a certain activity CAN or COULD have a negative effect (depending on the way it is carried out) then it is considered jednání v hospodářské soutěži, i.e. the way I set my prices COULD have a negative effect on competition (if I set them in such a way as to harm my competitors), even if I, specifically, am setting my prices in compliance with fair business practices. The activity itself has the potential for harm if misused, so it's jednání v hospodářské soutěži. That's how I'd read it; otherwise, as you say, it doesn't make sense.

negotiations in economic competition

just a quick guess, but it sounds like price fixing by an oligarchy, whereby different participants/players in a competitive market environment deal behind closed doors and hence it is no longer total competition as it is supposed to be.
