Rozsudek
To znamená, že odvolací soud, dospěl-li k závěru, že nebyly předloženy důkazy
prokazující závazek žalované ze smlouvy, jeho výši a aktivní legitimaci žalobkyně,
a žalobkyni s tímto svým názorem prostřednictvím poučení podle ustanovení § 118a odst. 3
o. s. ř. neseznámil, a to tím spíše, že posoudil věc po právní stránce jinak než
podle žalobkynina právního názoru i názoru soudu prvního stupně, zatížil řízení vadou, jež
mohla mít za následek nesprávné rozhodnutí ve věci ve smyslu ustanovení § 241a odst. 2
písm. a) o. s. ř.
Předem děkuji
prokazující závazek žalované ze smlouvy, jeho výši a aktivní legitimaci žalobkyně,
a žalobkyni s tímto svým názorem prostřednictvím poučení podle ustanovení § 118a odst. 3
o. s. ř. neseznámil, a to tím spíše, že posoudil věc po právní stránce jinak než
