English term

click-wrap licence

GBK English to Romanian Law/Patents Law: Patents, Trademarks, Copyright
A licence concerning the use of a copyright work, usually a software product, that includes pre-drafted terms and conditions of sale that consumers are required to agree to before being able the work. These terms and conditions are usually non-negotiable. A consumer is required to mouse "click" on an "agree" button before being able to load or use the program.
Example sentences:
Individual genotypes were made available on the HapMap website, but anyone seeking to use the research data was first required to register via the website and enter into a click-wrap licence for the use of the data. (Dept of Chemistry - Cambridge University)
Under Canadian law, a licensee is bound by all the terms of a licence contract if at the moment of acceptance, the licencee had actual knowledge of the existence of the contract. Since the click-wrap procedure only allows software to be downloaded after the licencee has seen the licencing contract, the enforceability of click-wrap licences is generally not an issue. (Ridout & Maybee LLP)
his Click-Wrap Licence Agreement is a user licence (for either a single or a corporate licensee) for software either downloaded from a website or loaded from disk, where the licence terms are accepted on screen by following a "click to accept" procedure. (Clickdocs®)

licenta de accept electronic

I found this term "click-wrap" left "as is" in the target language, like many others... I consider "accept electronic" a more appropriate one.

Personal nu-mi place cum suna "clicare", face legatura cu "clica" "clan" "sleahta", gasca in scopuri reprobabile.

Example sentences:

Note from asker:

Netscape Communications Corp., 150 F.Supp.2d 585 (S.D.N.Y. 2001), aff'd, 306 F.3d 17 (2d. Cir. 2002),

An earlier case, Specht v. Netscape Communications Corp., 150 F.Supp.2d 585 (S.D.N.Y. 2001), aff'd, 306 F.3d 17 (2d. Cir. 2002), gave perhaps the clearest definition of a clickwrap license.

A click-wrap license presents the user with a message on his or her computer screen, requiring that the user manifest his or her assent to the terms of the license agreement by clicking on an icon. n12 The product cannot be obtained or used unless and until the icon is clicked. For example, when a user attempts to obtain Netscape's Communicator or Navigator, a web page appears containing the full text of the Communicator / Navigator license agreement. Plainly visible on the screen is the query, "Do you accept all the terms of the preceding license agreement? If so, click on the Yes button. If you select No, Setup will close." Below this text are three button or icons: one labeled "Back" and used to return to an earlier step of the download preparation; one labeled "No," which if clicked, terminates the download; and one labeled "Yes," which if clicked, allows the download to proceed. Unless the user clicks "Yes," indicating his or her assent to the license agreement, the user cannot obtain the software.

The term "click" here is deemed to be a key term for the click-wrap license and was therefore included in the Romanian translation.
