DRAFT BLUE FLAG ECO-TOURISM BOAT CRITERIA
AND EXPLANATORY NOTES

INTRODUCTION
The Blue Flag programme for beaches, marinas and eco-tourism boats is run by the international, non-governmental, non-profit organisation FEE (the Foundation for Environmental Education). The Blue Flag programme was started in France in 1985. It has been operating in Europe since 1987 and in areas outside of Europe since 2001, when South Africa joined. Today, Blue Flag has become a truly global programme with an ever-increasing number of countries participating in the programme.
The Blue Flag programme promotes sustainable development in freshwater and marine areas. It challenges local authorities, beach operators and eco-tourism boat tour operators to achieve high standards in the four categories of: water quality, environmental management, environmental education and safety. Over the years, the Blue Flag has become a highly respected and recognised eco-label working to bring together the tourism and environmental sectors at local, regional and national levels to ensure responsible tourism.
The explanatory notes given in this document make up the common and shared understanding of the Blue Flag eco-tourism boat criteria and the requirements for the implementation thereof. The explanatory notes provide details on the measurement and management of compliance with the Blue Flag eco-tourism boat criteria.
The criteria are categorised as either imperative or guideline. Most eco-tourism boat criteria are imperative, i.e. the eco-tourism boat tour operator must comply with them in order to be awarded Blue Flag accreditation. If they are guideline criteria, it is preferable that they are complied with, but not mandatory. In the case that an eco-tourism boat tour operator cannot comply with one or more of the imperative criteria the tour operator can apply for a dispensation. Appendix A gives further information about dispensation cases.
It must be emphasised that the Blue Flag eco-tourism boat criteria in this document are the minimum criteria. A national programme can choose to have stricter criteria to what is outlined here.
These eco-tourism boat criteria and explanatory notes are to be used by all Blue Flag applicants in order to understand the requirements that must be met before an eco-tourism boat tour operator can receive Blue Flag accreditation. For guidance purposes, this document should also prove valuable for the management of those eco-tourism boat tour operators already accredited with Blue Flag status. The eco-tourism boat criteria and explanatory notes also serve as a guide for the National, Regional and International Blue Flag Juries when making decisions about a Blue Flag eco-tourism boat candidate.
During the Blue Flag certification period the flag must be present on all eco-tourism boats. The flag is both a symbol of the programme being run on the eco-tourism boat but also an indication of compliance.
If an eco-tourism boat tour operator that has Blue Flag accreditation does not comply with the Blue Flag criteria, the flag may be permanently or temporarily withdrawn from the boats. There are several degrees of non-compliance:
1. A minor non-compliance is where there is a problem with only one criterion of minor consequence to the health and safety of the eco-tourism boat passengers, of the staff or to the environment. When minor non-compliance occurs and can be immediately rectified, the flag is not withdrawn and the non-compliance is only registered in the control visit report. If however, a minor compliance cannot be fixed immediately, the eco-tourism boat tour operator is given 10 days in which to comply fully with all criteria. The flag is only withdrawn if the problems are not rectified within the 10 days.
2. Multiple non-compliances relates to non-compliance of two to three criteria but of minor consequence to the health and safety of the eco-tourism boat passengers, of the staff or to the environment. When multiple non-compliances occur, the eco-tourism boat tour operator is given 10 days in which to comply fully with all criteria. The flag is withdrawn if the problems are not rectified within the 10 days.
3. Major non-compliance is where the eco-tourism boat does not comply with one or several criteria, the result of which can have consequence to the health and safety of the eco-tourism boat passengers, of the staff or to the environment, as well as the general perception of the eco-tourism boat and therefore the programme. When met with major non-compliance, the flag is withdrawn immediately and for the rest of the certification period. The tour operator is registered as 'withdrawn' on the Blue Flag website, and there has to be information on board and/or in the office of the eco-tourism boat tour operator that clearly indicates that the Blue Flag status has been withdrawn and why it has been withdrawn.
In all cases of non-compliance, the National Operator must immediately inform the local authority/eco-tourism boat tour operator about the observed areas of non-compliance. The local authority/eco-tourism boat tour operator must inform the National Operator of re-compliance with the criteria and present the appropriate documentation needed. The flag can then be raised on the boat again. The National Operator should also consider a follow-up control visit to check that the tour operator does comply. In the event that the local authority/eco-tourism boat tour operator does not ensure and document re-compliance with the criteria within 10 days, the National Operator must ensure that the Blue Flag is withdrawn for the rest of the certification period.
In the event that conditions on the eco-tourism boat change and the flag has to be temporarily withdrawn, the tour operator must inform the National Operator that the flag has been temporarily withdrawn, as well as for which reasons, and the international website must be changed accordingly.
Apart from updating the Blue Flag website of the status of the eco-tourism boat tour operator, the National Operator must inform Blue Flag International about the non-compliance. If the non-compliance is noted by an international controller, the National Operator has to give feedback to Blue Flag International within 30 days.
The applicant for Blue Flag accreditation is the authority charged with responsibility for the eco-tourism boat. This may be the owner/head of an eco-tourism boat tour operator. The term eco-tourism boat refers to any kind of boat which is operated in an environmentally friendly way and which promotes environmental education among tourists.
All Blue Flag accredited eco-tourism boats have to comply with the general Blue Flag criteria for eco-tourism boats. Depending on the activity offered to the tourists, the eco-tourism boat also has to comply with the respective additional criteria. If more than one activity is offered at the same time on one boat, the eco-tourism boat has to comply with all additional sets of criteria which are relevant. Furthermore, the tour operator’s ticket offices/ticket booths and other buildings that are open to the public are also subject to the criteria (In the following ‘buildings’ refer only to those that are accessible to the public).
The certification period for eco-tourism boats is determined by the operating season. The certification is valid for only one operating season which means that it has to be renewed every year. However, if the eco-tourism boat activity is offered all year round the Blue Flag is being awarded for one year from the date of the awarding.
FEE, and the National Operator in a country, reserves the right to refuse or withdraw Blue Flag accreditation from any eco-tourism boat where the tour operator is responsible for violations of national environmental regulations or otherwise acts in discord with the objectives and spirit of the Blue Flag programme. Blue Flag eco-tourism boats are subject to announced and/or unannounced control visits by FEE International and the National Operator.

El programa de Blue Flag para playas, puertos deportivos y barcos de ecoturismo está organizado por la fundación internacional, no gubernamental y sin fines de lucro FEE (Fundación Europea de Educación Ambiental). El programa Blue Flag se inició en Francia en 1985 y opera en Europa desde 1987 y en otras aéreas desde 2001, cuando se unió Sudáfrica. Hoy en día, Blue Flag se ha convertido en un programa global con un creciente número de países participantes.
El programa Blue Flag promueve el desarrollo sostenible en agua dulce y zonas de puertos deportivos. Desafía a las autoridades locales, operadores de playa y tours de barcos de ecoturismo para conseguir altos niveles en las categorías de: calidad del agua, gestión medioambiental, educación medioambiental y seguridad. Durante los años, Blue Flag se ha convertido en una ecoetiqueta altamente respetada y reconocida, trabajando para traer los sectores de turismo y medio ambiente a niveles locales, regionales y nacionales para garantizar el turismo responsable.
Las notas aclaratorias de este documento compilan las creencias comunes y compartidas de los criterios de barcos de ecoturismo de Blue Flag y los requisitos de implantación de la misma. Las notas aclaratorias proporcionan detalles de las medidas y el manejo del cumplimiento de los criterios de barcos de ecoturismo de Blue Flag.
Los criterios están categorizados como imperativos o como guía. La mayoría de los criterios de barcos de ecoturismo son imperativos, es decir, el operador del barco debe cumplirlos para poder recibir la acreditación de Blue Flag. Si los criterios son como guía, su cumplimiento es recomendable, aunque no obligatorio. En el caso de que el operador de turístico de un barco de ecoturismo no pueda cumplir uno o más de los criterios imperativos podrá solicitar una exención. El apéndice A proporciona más información sobre casos de exención.
Conviene destacar que los criterios de barcos de ecoturismo de Blue Flag en esto documento son mínimos. Un programa nacional podría decidir tener criterios más estrictos de los aquí expuestos.
Estos criterios de barcos de ecoturismo y notas aclaratorias deben ser seguidos por todos los solicitantes de Blue Flag para poder entender los requisitos que deben cumplirse antes de poder recibir acreditación como operador turístico de barcos de Blue Flag. Este documento debe además servir como guía para la gestión de aquellos operadores de barcos de ecoturismo que ya cuenten con acreditación de Blue Flag. Los criterios de barcos de ecoturismo y las notas aclaratorias también sirven como guía para los Jurados Nacional, Regional e Internacional a la hora de tomar decisiones sobre los barcos de ecoturismo candidatos de Blue Flag.
Durante el período de certificación de Blue Flag la bandera debe estar presente en todos los barcos de ecoturismo. La bandera es un símbolo del programa que sigue el barco de ecoturismo pero también una indicación de su cumplimiento.
Si un operador de barco de ecoturismo que tiene acreditación de Blue Flag no cumple con los criterios, la bandera podría ser retirada del barco de manera permanente o temporal. Estos son los varios grados de incumplimiento:
1. Un incumplimiento menor se da cuando hay un problema con solo uno de los criterios de menor consecuencia para la salud y seguridad de los pasajeros del barco de ecoturismo, de la tripulación o del medio ambiente. En caso de que el incumplimiento menor pueda ser rectificado de inmediato, la bandera no se retira y el incumplimiento solo queda registrado en el informe de control de visitas. Sin embargo, si el incumplimiento menor no puede ser rectificado de inmediato, se le darán 10 días al operador del barco de ecoturismo para efectuar el cumplimiento total de los criterios. Solo se retira la bandera si los problemas no son rectificados en un plazo de 10 días.
2. Incumpliento múltiple se da cuando no se cumplen dos o tres criterios de consecuencia menor para la salud y seguridad de los pasajeros del barco de ecoturismo, la tripulación o el medio ambiente. En caso de incumplimiento múltiple, se le darán 10 días al operador del barco de ecoturismo para efectuar el cumplimiento total de los criterios. Se retira la bandera si los problemas no son rectificados en un plazo de 10 días.
3. Incumplimiento mayor se da cuando el barco de ecoturismo no cumple con uno o varios criterios cuyo resultado puede tener consecuencias para la salud y seguridad de los pasajeros, la tripulación o el medio ambiente, además de la percepción general del barco de ecoturismo y por extensión del programa. En caso de incumplimiento mayor, la bandera es retirada de inmediato y durante el resto del período de certificación. El operador turístico se registra como “retirado” en la página web de Blue Flag, y se informará a bordo y/o en la oficina del operador del barco de ecoturismo de que el certificado de Blue Flag ha sido retirado y los motivos por los cuales ha sido retirado.
En todos los casos de incumplimiento, el operador nacional debe informar inmediatamente a la autoridad local o al operador de barcos de ecoturismo sobre las areas en que el incumplimiento haya sido observado. La autoridad local o el operador de barco de ecoturismo debe informar al operador nacional del re-cumplimiento de los criterios y presentar la documentación necesaria. En ese momento la bandera puede ser alzada de nuevo. El operador nacional debe considerar además una visita de seguimiento para comprobar si el operador cumple con los criterios. En caso de que la autoridad o el operador de barco de ecoturismo no aseguren y documenten el cumplimiento con los criterios en 10 días, el operador nacional debe asegurarse de que la bandera sea retirada durante el resto del período de certificación.
En caso de que las condiciones del barco de ecoturismo cambian y la bandera tuviera que ser temporalmente retirada, el operador turístico debe informar al operador nacional de que la bandera ha sido temporalmente retirada, además de los motivos, y la página web internacional debe ser modificada acordemente.
Además de actualizar la página web de Blue Flag con el estado del operador del barco de ecoturismo, el operador nacional debe informar a Blue Flag International sobre el cumplimiento. Si un controlador internacional se percatara de un caso de incumplimiento, el operador nacional deberá proporcionar información a Blue Flag International en un plazo de 30 días.
El solicitante de la acreditación de Blue Flag es la autoridad responsable del barco de ecoturismo. Esta autoridad puede ser el dueño/jefe del operador de barcos de ecoturismo. El término barco de ecoturismo hace referencia a cualquier barco que respete el medio ambiente y que promueve la educación medioambiental entre los turistas.
Todos los barcos de ecoturismo con acreditación de Blue Flag deben cumplir con los criterios generales de Blue Flag para barcos de ecoturismo. Dependiendo de la actividad ofrecida a los turistas. El barco de ecoturismo debe también cumplir con los respectivos criterios adicionales. SI se ofrece más de una actividad al mismo tiempo en un barco, el barco de ecoturismo debe cumplir con todos los criterios adicionales que sean relevantes. Además, las taquillas de los operadores turísticos y otros edificios que están abiertos al público también deben cumplir los criterios (a partir de aquí “edificios” se refiere solo a aquellos accesibles al público).
El período de certificación para barcos de ecoturismo está determinado por la temporada operante. La certificación es válida durante la estación operante, lo que significa que debe ser renovada cada año. Sin embargo, si el barco de ecoturismo ofrece actividades todo el año la certificación de Blue Flag dura un año desde la fecha de su concesión.
La FEE y el operador nacional de cada país se reserva el derecho de rechazar o retirar la acreditación de Blue Flag de cualquier barco de ecoturismo donde el operador turístico es responsable de alguna violación de las regulaciones nacionales de medio ambiente o actúa en desacuerdo con los objetivos o el espíritu del programa Blue Flag. Los barcos de ecoturismo de Blue Flag están sujetos a inspecciones de control anunciadas o inesperadas por la FEE y el operador nacional.
