"Wizerunek jest jednym z dóbr osobistych wyraźnie wymienionych w art. 23 KC Pojęcie to pojawia się również w art. 81 PA, który konkretyzuje przepisy kodeksowe. Umiejscowienie tego przepisu w tej właśnie ustawie jest wyłącznie wynikiem pewnej tradycji, bowiem prawo do wizerunku nie jest prawem własności intelektualnej ani tym bardziej prawem autorskim.
Zazwyczaj definiuje się wizerunek jako ustalenie w jakiejkolwiek formie zdolnej do rozpowszechnienia obrazu fizycznego (wyglądu) człowieka. Może to być podobizna utrwalona na zdjęciu, taśmie filmowej lub w formie rysunku (w tym karykatury), czy też ustalona w przekazie telewizyjnym „na żywo”. Niekiedy pojęcie to rozszerza się również na szczególny sposób poruszania, zachowania i gestykulacji. Z kolei głos (w sensie jego brzmienia) traktuje się jako osobne dobro osobiste. Askerkę natomiast proszę o kontekst, bo "tytuł" nie jest żadnym kontekstem, chyba że, jak mawia Jerzy, tytuł spadł był z nieba, a Duch Lasu Sherwood szepnął Askerce do ucha prośbę o przetłumaczenie. W takim wypadku naprawdę byłby problem. :)
