The Judicial Commissioner's Report regarding an insolvent company:
Procedimento di Concordato Preventivo in continuità
under the heading "le ipotesi alternative", which include bankruptcy:
In caso di fallimento, almeno per quanto riguarda le analisi fino a ora condotte, non appare possibile ipotizzare un incremento dell’attivo disponibile per delle azioni di responsabilità nei confronti degli amministratori per fatti riconducibili a ipotesi di bancarotta o altro.
I'm not sure what these "azioni di responsibilità" are. Any suggestions appreciated. Thanks!

liability actions ...
against the directors
Basically you take the directors to court claiming damages from them for failing to do their duty properly.

I know the term mainly because of the insurance policies taken out to cover it which appear on balance sheets.

"liability actions" would cover both nonfeasance (failing to act) and misfeasance (doing the wrong thing) and possibly malfeasance (doing it intentionally).

I'll assume 'per delle' is equivalent to 'pour des' in FR (for some or several).

: assuming that Fr and Italian are the same can be very dangerous./Assuming it is cognate with Spanish also has to be done carefully. I'll leave all the answering to you. I am fluent in Italian but don't translate it professionally.

I don't, but that Italian is cognate with Spanish. Assuming you are familiar with misfeasance proceedings against co directors, let's have your translation then. Full points for arguing malfeasance!//Perhaps judge answers on their merits and not on whims.

: Being Italian, I can confirm your assumption is correct. However Jim's "liability actions" (as you quote yourself in the explanation!) is a better alternative IMHO.

Grazie! Being in the law almost half a century, I have brought tort actions & been privy to misfeasance proceedings brought against directors by insolvency practitioners, whilst recall only 'strict-liability actions in tort', not even ins. liability suits
