Another sentence this appears in: Debiendo precisarse que entre la fecha que media entre la última letra vencida y la fecha de citación con la demanda, han transcurrido aproximadamente doce años.

Subpoena (or: summon to appear on a certain date)

Bear in mind that citación is distinguished from emplazamiento in legal Spanish. A citación is to appear (for trial or a hearing) on a certain date and emplazamiento is appear or do perform a certain act within the time period specified by it. In find "con la demanda" quite redundant (as a citación (almost) always indicates a compaint) and thus unnecessary to be rendered.

Tom West has an example under Reconvención:
• Hay que requerir al deudor para constituirle en mora. La reconvención judicial se produce con la citación con la demanda.
• To be deemed officially in default, the debtor must be served with a formal demand for payment. Such formal demand occurs when the complaint is served on the debtor.

PARA QUE SE PUEDA EJERCITAR el derecho de defensa, la demanda debe ser citada al demandado o demandados, así se asegura la vigencia del principio de contradicción, poniendo en conocimiento del demandado las pretensiones formuladas por el actor y para que conteste la demanda.

La citación

La citación es el acto por el cual se hace saber al demandado el contenido de la demanda o del acto preparatorio y las providencias recaídas en esos escritos.
El Art. 78 del Código de Procedimiento Civil señala: "En el proceso se extenderá acta de la citación, expresando el nombre completo del citado, la forma en que se hubiera practicado y la fecha, hora y lugar de la misma.
De la notificación, el actuario sentará la correspondiente razón, en la que se hará constar el nombre del notificado y la fecha y hora de diligencia. En una sola razón podrá dejarse constancia de dos o más notificaciones hechas a distintas personas. El acta respectiva será firmada por el actuario".
