English term

not hereby or by any codicil hereto otherwise

English to Spanish Law/Patents Law (general) Wills
Hi, can someone help me to detangle this sentence?

It reads as follows:

"I GIVE DEVISE AND BEQUEATH all my real Estate whatsoever and wheresoever ***not hereby or by any codicil hereto otherwise*** specifically disposed of to my wife....

Discussion

John Rynne Feb 28, 2022:
You have to chop it up differently in Spanish I think you have to bring the wife (and whoever else is cited there) into the translation: que no se haya legado específicamente a mi esposa mediante este testamento (?) o mediante los codicilios del mismo, en su caso, …

So it's impossible to just translate the query phrase in isolation

que no se haya legado de otra forma por el presente u otro codicilio, a mi esposa

It's difficult to conclude more confidently because there is not enough context to do so. I think Adrian's analysis is good, but I felt the 'comma' should come after 'disposed of' rather than 'wife' (first 'comma' would be after 'wheresoever' and second comma after 'disposed of').

If he is leaving everything in his will to his wife except for some clauses specified in the will, then this suggestion is correct.

If he is leaving everything in his will to others except for some clauses specified in the will benefiting his wife, then Adrian's suggestion is correct.

It depends on your understanding of the wider context.

English term (edited): not hereby or by any codicil hereto otherwise specifically disposed of to my wife

que no se haya legado a mi esposa a título particular mediante este testamento o codicil/i/o a éste

I agree with John R. about expanding the phrase.

> modificación de éste is wider and could, besides a codicil, mean an amendment or interlineation or, controversially, a half-secret trust referred to in the Will and leaving property to a secret beneficiary.

Legado as a testamentary disposition of chattels, goods or money (bequest or legacy) vs. a devise of land rather than enajenado query: as a lifetime dealing,
though I wonder whether a later Will clause refer to 'property undisposed of', namely any forgotten by the Testator or which he comes into or inherits after the making of the Will.
Example sentence:

Desde un punto de vista descriptivo se podría definir el legado como una disposición testamentaria a título particular por el cual el testador beneficia a determinadas personas.

El codicilo puede complementar el testamento, pero no puede nombrar ni revocar herederos o albacea universal.

Gracias, Mónica, and thanks !
