In the present case, a Sale and Purchase Agreement of goods was concluded between the Claimant and Defendant. Article 6.305(1) of the CC states that in a Sale and Purchase Agreement, one party (the seller) undertakes to transfer an object (the goods) to the other party (the buyer) under the right of ownership or the right of trust, and the buyer undertakes to take delivery of the object (the goods) and to pay a specified sum of money (the price) for the goods.
