Spanish term

carácter constitutivo

Spanish to English Law/Patents Law (general) Puerto Rico
This appears twice below. I'm not sure about "constitutive" here but don't want to guess. It seems like "statutory" or maybe "mandatory"? Thanks in advance.

essential in nature to creation of a contract (formatively vital in nature)

Changing the emphasis to basic-law contract formation or creation of an 'inaugural' or prelim. contract - 'no nace a la vida jurídica...'

constitutivo : essential (Robb & Butterworths); constituent : query if law dictionaries and glossaries miss the 'creational' crux.

.. la exigencia de que todo contrato municipal sea por escrito tiene un carácter constitutivo : the requirement that every council contract is to be in writing is formatively vital in nature -> of a nature essential to creation of a contract

La exigencia de que los contratos con los municipios consten por escrito responde a un requisito de carácter constitutivo : ... the imposition that contracts with councils .... is in line with a requirement formatively vital in nature - essential in nature to contract formation.
Example sentence:

What is Contract Formation? A contract is legally enforceable because it meets the precise legal requirements to establish a contract.,

ProZ sentencia de caracter constitutivo > patinba: judgement establishing a legal right // Gabriela Ochoa: ... as (a) source of rights

essential/fundamental/ requirement
