French to English Law/Patents Law (general) Appeals court ruling
Taken from an appeals court ruling:

"En conséquence, il convient de déclarer recevables les pourvois formés par ces sociétés. Sur les moyens proposés pour les sociétés XXX, pris en leurs deuxième et troisième branches...le moyen proposé pour la société XYZ..."

Not understanding how "branche" is used in this context. Any suggestions?

Start with FHS Bridge's translations of "moyen":

moyen : cause of action, defence, ground of defence or claim, procedure, argument, allegation, type of evidence, point, submission, plea, ground of (for) appeal (page 209, The Council of Europe French-English Legal Dictionary)


If a "moyen" is an "argument", then a "branche", clumsily and literally translated, is a "sub-argument".

So, in neutral language, "branches" are points.

Depending on stylistics, register and intended effect, you can use any of the translations proposed by Bridge, or any similar ones you can come up with.

La branche: limb (of an argument etc.), Navarre.

BTW, the comment of 'This question was closed without grading. Reason: Answer found elsewhere' in Charlotte A's self-inserted answer of 'limb' had actually been down to my suggestion off-list to her good self. That (legally qualified) asker to confirm.

agree Mpoma : whoops! I have Navarre. That entry says "branch, limb, bough (d'arbre)". Hardly conclusive, Maître. OTOH 6 ghits on ["limb of grounds" legal argument] is good enough for me. I'd put "considering ..."
