لأنه الظاهر أمام غير المتعاقدين باعتباره دالاً علي ما اتفقا عليه ، كما يسمي ” العقد الصوري “
لأنه يخالف الحقيقة التي اتفق عليها المتعاقدان
والأصل أن ترد الصورية علي كافة العقود ، ومتي أظهر أحد المتعاقدين ورقة الضد
