I would eliminate the commas: they make the thought parenthetical
XXX may assess and the Customer shall pay a fine
Both parts refer to "the fine". There are "two" thoughts so they are not separated by commas. With three thoughts, yes, there would be a comma before "and," e.g., x, y, and z:
XXX shall assess, the Customer shall pay, and *** a fine..
Putting commas is equivalent to having a parenthetical thought:
XXX may assess (and the Customer shall pay) a fine...
